ABSTRACT Historically, maternal HIV research has focused on prevention of mother‐to‐child transmission and child outcomes, with little focus on the health outcomes of mothers. Over the course of the HIV epidemic, the approach to including pregnant women in research has shifted. The current landscape lends itself to reviewing the public health ethics of this research. This systematic review aims to identify ethical barriers and considerations for including pregnant and postpartum women living with HIV in treatment adherence and retention research. We (...) completed a systematic literature review following PRISMA guidelines with analysis using a relational ethics perspective. The included studies (n = 7) identified ethical barriers related to (a) women research participants as individuals, (b) partner and family dynamics, (c) community perspectives on research design and conduct, and (d) policy and regulatory implications. These broader contextual factors will yield research responsive to, and respectful of, the needs of pregnant and postpartum women living with HIV. While current regulatory and policy environments may be slow to change, actions can be taken now to foster enabling environments for research. We suggest that a relational approach to public health ethics can best support the needs of pregnant and postpartum women living with HIV; acknowledging this population as systematically disadvantaged and inseparable from their communities will best support the health of this population. Vague predicates, on a paraconsistent account, admit overdetermined borderline cases. I take up a new line on the paraconsistent approach, to show that there is a close structural relationship between the breakdown of soritical progressions, and contradiction. Accordingly, a formal picture drawn from an appropriate logic shows that any cut-off point of a vague predicate is unidentifiable, in a precise sense. Interfaith prejudice continues to be an understudied challenge in the United States. In three studies, the present research focused on prejudice between atheists and Christians and assessed the role that social identity complexity (SIC), the degree of overlap that an individual perceives between their various social identities, plays in these biases, as well as tested a novel intervention method using SIC to reduce bias. Study 1 assessed the relationship between SIC and prejudice for atheists and Christians and found that higher (...) SIC in Christians was associated with lower levels of prejudice, but SIC was unrelated to prejudice for atheists. Study 2 tested the utility of an SIC intervention for reducing prejudice in Christians and showed a small increase in SIC but no reduction in prejudice towards atheists. A mini meta-analysis in Study 3 assessed the relationship between SIC and prejudice across all three studies and fully replicated Study 1. This line of work was an important first step in uncovering the relationship between SIC and interfaith intolerance for atheists and Christians in the United States. The findings suggest that SIC interventions may have potential for reducing prejudice in Christians, but future researchers will need to use methods that can be tested longitudinally for greater impact. In his ‘On t and u and what they can do’, Greg Restall presents an apparent problem for a handful of well-known non-classical solutions to paradoxes like the liar. In this article, we argue that there is a problem only if classical logic – or classical-enough logic – is presupposed. 1. Background Many have thought that invoking non-classical logic – in particular, a paracomplete or paraconsistent logic – is the correct response to the liar and related paradoxes. At the most (...) basic level, the target non-classical idea is that some expressions, like ‘all and only the true propositions’, do not behave as we would expect from classical logic. Non-classical theorists argue that the class of all and only the truths is either incomplete or inconsistent: when you truly speak of all and only truths , you're either leaving some truths out, or you're letting some untruths in. Truth, in a slogan, is either gappy or glutty. Non-classicality is not a glib or easy-way-out response to the paradoxes. Innocuous-seeming notions can turn out to be philosophically substantial. Moreover, apparently correct forms of reasoning can turn out to be incorrect. To take a example, a glut theorist must hold that the following argument form is not in general valid. Either p is true or q is true. But p is untrue. So q is true. This argument form may strike our ears as acceptable. But if p is a truth value glut, then the inference fails to preserve truth. According to glut theorists, the inference breaks down in inconsistent contexts: if the subject matter involves gluts, then the inference is to be rejected. And the liar paradox, according to such theorists, shows that truth is exactly the kind of subject matter that yields inconsistency. In the …. (shrink)

_Purpose._ The authors of this article aim to reveal how motivation and legitimacy ensure the normativity of the structuring and genesis of multiple social identity. _Theoretical basis._ Social constructivism was chosen as a research methodology. It reveals social identity as an identity constructed by its bearer on the basis of ready-made versions of social identity proposed by social groups and society. Social circles, identified by Georg Simmel, unite representatives of different social groups into a wider oneness, which can be interpreted (...) as a multiple social identity, and the motivation for its formation can be identified on the basis of Weber’s concept of legitimacy. _Originality._ Identifying the structure and genesis of a multiple social identity creates prerequisites for establishing its normative foundations, as well as for a specific analysis of the procedures for achieving its motivation and legitimacy. Georg Simmel’s concept of social virtues promotes consideration of the basic virtues of an individual as those that enable one’s to be a member of various social groups in which these virtues are manifested. _Conclusions._ The social virtues present in the social identities that are part of a multiple social identity determine not only the social status of these individuals in these social groups but also the ranking and normative significance of these groups for this individual. If the observance of virtues in a certain social group causes a higher motivation of an individual’s behavior, then this group acquires a higher legitimacy for her/him. Using the example of virtues, it is possible to search for other possible grounds for the formation of multiple social identity. Such grounds are primarily other characteristics of key social practices that support different social groups. (shrink)

Within the past few years, a new generation has joined the ranks of business managers or is preparing to become business managers: Generation Z (Gen Z), described as individuals born between 1995 and 2010. This paper has two aims: (1) to assess the Gen Z cohort framed by their value orientation preferences (VOP) and the importance given to principled moral reasoning (PMR) using values and cognitive moral reasoning theories and (2) to compare this information about the Gen Z cohort to (...) prior generations. Using the Rokeach Value Survey and the Moral Reasoning Inventory, we uncovered support for our expectations that Gen Zs would have a balanced set of VOP—that is, similar preferences for a personal and a social value orientation and similar preferences for a competence and moral value orientation. Further, Gen Z preferences are unlike prior generations. The importance given to principled moral reasoning to resolve ethical dilemmas is lower than Baby Boomers and Gen Xers but surprisingly higher than Millennials as found in prior studies. Implications of these discoveries and suggestions for future research are presented. (shrink)

Throughout the medieval period law was seen as the product of social groups and associations that formed legal orders, as Max Weber elaborates, "either constituted in its membership by such objective characteristics of birth, political, ethnic, or religious denomination, mode of life or occupation, or arose through the process of explicit fraternization." During the second half of the Middle Ages, roughly the tenth through fifteenth centuries, there were "several distinct types of law, sometimes competing, occasionally overlapping, invariably invoking different (...) traditions, jurisdictions and modes of operation." Types of law included imperial and royal edicts and statutes, canon law, unwritten customary law of tribes and localities, written Germanic law, residual Roman law, municipal statutes, the law of merchants and of guilds, and in England the common law, on the continent the Roman law of jurists after the twelfth century revival of the Justinian Code. The types of courts included various imperial and royal courts, ecclesiastical courts, manorial or seigniorial courts, village courts, municipal courts in cities, merchant courts, and guild courts. Serving as judges in these courts, respectively, were kings or their appointees, Bishops and abbots, barons or lords of the manor or their appointees, local lay leaders, leading burghers, merchants, and members of the guild. These various positions were not wholly separate-many high government officials were in religious orders, while Churches held landed estates that came with local judicial responsibilities. "Bishops, abbots and prioresses, as lords of temporal possessions, controlled manorial or honorial courts at which they sometimes, though not generally, presided in person, exercising responsibility for criminal and customary law." "The result was the existence of numerous law communities," Weber wrote, "the autonomous jurisdictions of which overlapped, the compulsory, political association being only one such autonomous jurisdiction in so far as it existed at all." Jurisdictional rules for judicial tribunals and the laws to be applied related to the persons involved and the subject matter at issue. The personality principle linked law to a person's community or association, and under feudalism property ownership came wrapped together with the right to judge those tied to the property. "Demarcation disputes between these laws and courts were numerous." Jurisdictional conflicts arose especially in relation to ecclesiastical courts, which claimed broad jurisdiction over personal status laws (marriage, divorce, inheritance) and moral crimes, as well as church property and personnel, matters which regularly overlapped with the jurisdiction of other courts. Furthermore, different bodies of law could be applicable in a given court in a given case. "It was common to find many different codes of customary law in force in the same kingdom, town or village, even in the same house, if the ninth century bishop Agobard of Lyons is to be believed when he says, 'It often happened that five mem were present or sitting together, and not one of them had the same law as another.'" In long settled areas, the personal law of communities became local customary law. People living within cities were subject to municipal statutes and customary law on certain matters (penal law, procedural), and the community law to which they were attached. (shrink)

A review of extent business ethics research uncovered well over 200 published articles that investigated the role of job functions within a business organization as an explanatory factor of ethical or unethical behavior. While an important body of work, ethical breaches are often found to cut across job functions and involve multiple disciplines embedded in a business organization. This research seeks to explore a crossfunctional explanation for ethical reasoning by using an instrument new to business ethics research, the Wason selection (...) task, but well-grounded and validated in cognitive research and evolutionary psychology, to assess an individual's ability to detect rule-based social contract violations. A sample of 276 full-time business practitioners, enrolled in part-time M.B.A. programs, from the accounting, finance, information technology, marketing, supply chain, and human resource management job functions were compared on their ability to detect rule violators across a series of production scenarios in the Wason selection task. Rates of cheater detection were calculated to determine if substantive differences existed across job functions. This was followed by a series of pairwise comparisons of percentages of cheater detection across the job functions using z-tests for assessing statistical significance. The data analysis showed differences in cheater detection, with most of the variance due to the marketing job function group. Insights from this study for scholars, educators, and practitioners in the business ethics field are discussed. (shrink)

Práce se zabývá metodologickou stránkou teorie lidského jednání, která vznikla v rámci Weberovy rozumějící sociologie a byla dále transformována ve fenomenologické sociologii Alfreda Schütze. Analýza se zaměřuje především na to, jakým způsobem se oba myslitelé pokusili vyřešit problém interpretace lidského jednání ze strany (vědeckého) pozorovatele a samotného aktéra. Ukazuje se, že Weber stojí i přes snahu zůstat v kontaktu s psychologickou realitou jednání vždy již na pozici vědeckého pozorovatele. Schütz usiluje o důkladnější založení weberiánského postoje a ukazuje, jakým způsobem (...) stanovisko nezaujatého pozorovatele vystupuje z bezprostředně ("naivně") prožívané reality přirozeného světa. Oba myslitelé diskutují otázku racionality jednání a v závěru dospívají k přesvědčení, že racionalita (chápaná jako logická konzistence a empirická efektivita jednání) není ani tak charakteristikou, která by připadala "reálnému" jednání, ale spíše normou vědeckého popisu a vědeckého postupu. Argumentace je rozvinuta v rámci úvahy o chápání racionality v současné ekonomické teorii a roli introspekce. (shrink)

Der Begriff der Intentionalität stellt einen der grundlegenden Begriffe in der Philosophie Webers dar. In Anlehnung an Brentano gibt er in seinen Frühwerken mehrere Unterscheidungsmerkmale zwischen Psychischem und Physischem an, welche er als Unterschied in der Gegebenheit, in der Realität, in der Erfassbarkeit, in der Beschaffenheit, in der Abhängigkeit und in der Gerichtetheit bezeichnet, wobei Unterschiede und Übereinstimmungen mit Brentano nahe liegen. Es wird gezeigt, dass sich Weber bei der Behandlung der Intentionalität vor allem auf Gedanken von Alexius Meinong (...) und dessen Schule stützt. Mit ihnen vertritt er jene Theorie, welche zwischen dem Inhalt und dem Akt einerseits und dem Gegenstand andrerseits unterscheidet – er nimmt den so genannten „gegenstandstheoretischen Dualismus“ an. Außerdem meint er in seinen Frühschriften, dass alle Erlebnisse einen Gegenstand besitzen, unabhängig davon, ob diesel tatsächlich existiert bzw. besteht. Um etwa 1930 hat Weber plötzlich seine Ansicht geändert und behauptet nun, dass es auch nicht-intentionale Erlebnisse gibt, welche auf keinen bestimmten Gegenstand hinweisen. In diesem Zusammenhang unterscheidet er vorintentionale und nachintentionale nicht-intentionale Erlebnisse, wie z.B. Instinkte bzw. Triebe und Stimmungen. (shrink)

The author describes the moment of the emergence of the concept of sovereignty, its causes, historical significance, as well as the issues raised in the debate over this concept since the seventeenth century. Sovereignty refers to the state and points to its essential feature, which defines the state as the result of occidental rationalism (Max Weber). According to this definition, the state is different from other, earlier and parallel political forms, such as republics and empires. However, changes in the (...) history of the state also affect the way in which sovereignty is understood. Consequently, the concept of sovereignty is often difficult to justify or is even – as some authors claim – anachronistic. The author outlines different approaches in the discussion about the validity of this concept and their premises. He also describes the relationship between the principle of sovereignty and the democratic rule of law. (shrink)

In this paper I examine some difficulties with the argument presented as a topological sorites in Z. Weber and M. Colyvan, ‘A topological sorites’, Journal of Philosophy 107, 311–325. In particular, I suggest that the argument may be used to support the claim that sorites-type paradoxes cannot arise in a cohesive environment.

Aaron Antonovsky, the medical sociologist, defined the sense of coherence as a pervasive sense that the events in one’s life are comprehensible, manageable, and meaningful or worthwhile. Research on the sense of coherence indicates that it is positively correlated with resilience and adaptive coping with disabilities and illnesses. The collection of first–person narratives published in Narrative Inquiry in Bioethics on genetic testing can be understood as expressions of the human effort to restore or sustain a sense of coherence in the (...) face of illness, uncertainty, or even curiosity about one’s origins and future wellbeing. While the medical usefulness of the genetic testing that was discussed in the collection of narratives was often modest, the contribution of testing to the sense of coherence was often greater. Understanding the sense of coherence as a possible motive for genetic testing might reshape the way that we conceive of the benefits and the burdens of genetic testing and the disclosure of incidental findings.
